You’ll need to create an account with Artibus to use some of our Services.You must be 18 or older to use our Services .Be Honest; Falsifying information about yourself or any products is not allowed.Any offensive terminology or language is not allowed. Artibus is allowed to interpret when something is offensive in manner.
Be careful of intellectual property & trademark infringement.You’re solely responsible for any activity on your account (Regardless If the user is sharing an account) on any of Artibus’s services. The responsibility will be on the shoulders of the account holder. Artibus is not responsible for misuse or stolen account information.
Artibus allows you to link your external website for personal promotion. You are not allowed to link ANY websites similar to ours. (I.e. marketplaces, shop URL, or any other third party venue selling goods other than personal websites). The user(s) social media platforms are okay to link (Assuming they follow all policies)
Artibus is not liable for any unpaid taxes from user(s). User(s) are solely liable for any applicable taxes from selling products. The user agrees that Artibus is not responsible for withholding taxes, or paying any applicable taxes incurred from the users(s) sold items on the website.
Artibus is not responsible for any legal documentation needed to sell items. It is the user(s) responsibility to follow all State and County laws pertaining the sell of certain goods. It is the user(s) responsibility to obtain any licensing needed to sell certain goods in certain areas.
Both Artibus, LLC and sellers process members’ personal information (name, email address, and shipping address). Each party is responsible for the personal information it processes in providing the Services. Artibus, LLC, will not be responsible for any unauthorized disclosures by users.
Users content is defined as, but not limited to the following:
- Shop names
- Listings Information
- Any comments made on website
- Any pictures (products , profile, etc.)
You Represent That You Understand And Have Read Artibus’s Policies.
Specifically about trademark infringement (intellectual property). Be aware that all content on website published can be seen by anyone browsing the internet.
Artibus will use user(s) content to promote Artibus, for the purpose of growing our community. In turn, this will provide growth to your selling platform and extend reach of customers. Artibus will never claim any product as our own. If you object to any of our usage of promoting content of yours, please send us an email email@example.com. By posting listings, pictures of products, shop information, on our website, you grant Artibus a temporary license to all the above for such use.
If content that you own or have rights to has been posted to the Services without your permission, please contact Artibus at firstname.lastname@example.org. Provide pertinent documentation to support your cause.
You may cancel your account with Artibus at any time from your account settings. If the user needs additional help, please contact us and Artibus will assist in cancelation.
Artibus has the right to cancel or suspend your account and your access to the services at any time, for any reason, and without advance notice. Artibus may refuse service or discontinue service to anyone, at any time, for any reason.
Artibus is a Peer-2-Peer marketplace. Artibus does not have, nor is affiliated with any products sold on Artibus. Artibus simply provides the means for an outlet to sell. Nothing more. Artibus cannot and does not make any warranties about their quality, safety, or even their legality.
You release Artibus from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers, or items that caused physical injury.
Our Services contain third-party websites (Users Accounts) or services (PayPal & Stripe) that we are not affiliated with. Users will use these services at their own risk. Artibus is not liable for any unlawful act or lawsuit resulting from these services. Artibus is not liable to you for any lost profits or revenues. This includes lost time because of account holds.
If Artibus gets sued because of something that you did, you agree to defend and indemnify us. We reserve the right to handle our legal defense however we see fit.
Disputes With Other Users
When in dispute with another user of Artibus’s Services or a third party, you need to contact the other party and try to resolve the dispute. Artibus will intervene if necessary. However, Artibus can’t guarantee a successful resolution for any party. You release Artibus from any claims, demands, and damages arising out of disputes with other users or parties.
Disputes With Artibus
The Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws rules, and the laws of the United States of America. These laws will apply no matter where in the world you live.
You and Artibus agree that any dispute or claim arising from or relating to the Terms shall be finally settled by final and binding arbitration, using the English language, administered by the American Arbitration Association under its Commercial Arbitration Rules.
Any arbitration under the Terms will take place on an individual basis and class actions are not permitted. You understand that by agreeing to the Terms, you and Artibus are each waiving the right to trial by jury or to participate in a class action or class arbitration. We are based in Columbia, Missouri USA, so any legal action against Artibus related to our Services must be filed and take place in Missouri.
Amendments To Terms
We will update these Terms as needed. We will give appropriate notice by means of e-mail, or through the website itself. Users will be able to cancel membership at this time and end service if terms are not agreed upon. We will attempt contact by the information given to Artibus by the user(s). Artibus is not responsible if the user(s) could not be informed by not having current or having wrong contact information given by the user(s).
